AG Files Suit against Charter Communications Missouri Missouri Attorney General Chris Koster has filed a lawsuit in federal court against Charter Communications for violating federal and state telemarketing and No Call laws This is not the first case of its kind to be received by the office Unwanted telemarketing calls and harassing treatment by telemarketers annually rank highest on the list of complaints filed at the Attorney General s Office According to a statement posted on the Attorney General s official website his office received 350 No Call complaints about harassing practices by Charter s telemarketers Many consumers complained about daily calls from Charter and some consumers received up to three calls a day The calls were an attempt to sell Charter s cable Internet and phone services There is no excuse for a business operating in Missouri to ignore our no call laws Koster said We ask consumers to continue helping us fight illegal unwanted telemarketing calls by reporting violations to our office as 350 Missourians did about Charter As reported by www consumerfinancialserviceslawmonitor com Koster s complaint generally alleges that Charter Communications and its vendors placed at least thousands of telemarketing calls to Missouri consumers even after the consumers asked that Charter stop calling The complaint specifically alleges that individual consumers received dozens of calls in less than a year and up to five calls per day Despite requests for the calls to cease Charter allegedly informed consumers that it would take forty five days to place consumers on its internal do not call list Among the damages sought through the complaint include 16 000 for each violation of the federal Telemarketing Sales Rule TSR at least 500 for each violation of the federal Telephone Consumer Protection Act TCPA up to 5 000 for each violation of the state No Call statute and an unspecified civil penalty for each violation of the state Rankin Landowners Landowners in Montgomery and Rankin counties are up in arms with AT T over its laying of fiber optic cables which they allege was not properly done They claim that At t through its subcontractors has proceeded to lay cables on their lands without their prior consent The landowners fear that they will be blamed responsible for any damages that the cables experience which is why they are crying for justice One of the aggrieved landowners Tom Austin said AT T has clearly shown greed in the move they took It s a huge example of corporate greed and corporate arrogance he told The Clarion Ledger in an interview Already there are two federal lawsuits filed in relation to the matter and it will be difficult for the company to run away from liability One of the lawsuits allege that workers drove an already depressed elderly woman in Florence to commit suicide by lying that she had signed an easement that would have allowed crews on her property All this mess is as a result of the push by AT T to increase broadband internet accessibility deep into rural areas In a brief press statement the company defended its move Our policy is to comply with the law regarding placement of our network facilities Sue Burns is another landowner who is faced with a similar predicament with the cables eating into about 100 feet of her land There may be a push for internet service to be provided to everyone but back behind where they put it on my property there s no one living there she said We re a working farm working to earn money to pay taxes and we have had a liability imposed Montgomery Rankin Windstream Sued for Disability Discrimination One of America s leading network communications giants Windstream Communications has been sued for violating federal law by failing to accommodate a diabetic employee The lawsuit has been filed by the U S Equal Employment Opportunity Commission EEOC In the lawsuit EEOC says that Windstream hired the employee as an Associate Network Analyst at its Little Rock location in May 2013 Things went bad for the employee when she was assigned the night shifts As a result the employee suffered a fluctuation in the levels of her blood sugar since she did not have enough sleep The lawsuit further states that she requested the company for a transfer to a different shift or provision of reasonable accommodation which was turned down That resulted in the unnamed employee to resign prematurely EEOC is accusing Windstream of violating Title I of the Americans with Disabilities Act of 1990 ADA that was amended by the Americans with Disabilities Act Amendment Act of 2008 ADAAA The lawsuit has been filed at the U S District Court for the Eastern District of Arkansas Western Division and Civil Action No 4 15 cv 597 SWW Before going to court EEOC had sought to have an out of court settlement with Windstream but failed in their efforts Companies must not force an employee to choose

a tight copyright war of words over infringements of copyrights Each side accuses the other of violating the law Rightscorp has severally accused Cox of infringing the rights of its own customers But in defense Cox has said it is Rightscorp who shared thousands of copyrighted works without permission That is the basis of their new war whose end is not foreseen Cox was also sued last year by BMG Rights Management and Round Hill Music who accused the company of continuing to operate accounts of customers who were determined to have pirated content The two companies own publishing rights for songs produced by The Beatles Katy Perry and David Bowie among other top musicians In the recent case Rightscorp says they have gathered very vital information to show that Cox is in violation of copyright for its customers They have gone ahead to sue Cox with the case set to commence very soon But Cox has gone ahead to file their own papers trying to prove why the case has no basis and should be thrown out They are very much aware of the negative implications of such a case to their reputation In their summary judgment Cox says Rightscorp has not given out any solid evidence to prove that they are in violation of any copyright They further claim that the Rightscorp system has very many flaws thus their IP addresses are prone to being used by other people apart from the real account owners which amounts to infringement Plaintiffs made no effort to determine whether Cox account holders personally committed any infringements and they cannot tie IP addresses to specific infringers approve the merger When Ergen met representatives from FCC he told them that approving the merger will be unhealthy for the broadband and online video marketplaces He further urged that the combined force of the three companies will work against their rivals and undermine the spirit of healthy competition in the market Their main fear was that the move would lead to monopoly of Charter in the liberalized market But Charter has responded to that laughing off the fears expressed by Dish Network The statement said that New Charter will bring pro consumer and OVD practices to more homes without being too big New Charter would serve only 23 of subscribers receiving 25 Mbps and above and significantly less than the roughly 60 Comcast TWC would have served The company also said the deal would be smaller than the percentage Comcast serves today thus allayed any fears of enjoying market monopoly as it had been alleged New Charter will serve 21 of all wire line broadband customers which is less than Comcast and only slightly more than AT T Charter said it is not alone in the deal as many other operators are sounding positive on its prospects Netflix supports this merger and called
